There are few contractors and working bee’s here in the Mega-Plex of Dallas/Fort Worth whom are not aware that we the people will be at work Monday, til then and again I hope you have a day of rest. Before we start on today’s subject of difference between workers Compensation and other coverage’s we would like to extend our gratitude to you and anyone who stop by our small website/blog roll today. We are truly grateful and hope we can extend some type of help to you and your family for the protection of your assets. Here we go, let’s talk about the difference between your Dallas general liability insurance and workers compensation.

Worker’s Compensations

There are a lot of things to be addressed as concerns your workers compensation here in Texas, we will not get to all of them here yet throughout the year (2015) we will have numerous post/articles on the different intricacies of workers compensation. What I would like to address first is who is covered and who is not covered and “YOU” – the hiring contractor is responsible for. Now, this is something we hear all the time: “These guys that we have hired to do a job are independent contractors, therefore we are not responsible for their work or their workers compensation; meaning that there is no protection afforded to our subcontractor and “we” – are not responsible or liable for any injury that may occur on-the-job. Although it may seem reasonable to believe you are not responsible if a subcontractor were to become her – it is quite possible that you could end up being liable if someone is hurt that you have hired. Say you hire a

  • Electrician
  • Flooring Contractor
  • Framing Contractor
  • Roofing Contractor

The list will keep going, but you get the point: your company has hired a subcontractor, and said subcontractor is hurt on the job of some $300,000 of medical bills. Let us give you just one scenario that might show a small amount of light on what could happen.

I’ve Fallen and can’t get up

A contractor hired by you is hurt on the job that you hired them for, regardless of the negligence or how the accident happened the reality in this make-believe story is this – it happen – person is hurt – and now a claim has been filed on the homeowners insurance (liability part) – and there was a payment to the local hospital of $300,000. All seems well at this point, however it is not impossible that you could receive a bill from an attorney saying that you owe said insurance company the amount paid to the hospital. Yes, that $300,000 that has been paid is now become your burden says the attorneys that work for the insurance company that paid the claim. Remember the claim Was NOT Dallas General Liability Insurance.

We are not talking fair

Dallas General Liability Contractors Insurance -3-14We, are not talking about fair or unfair, what is right or reasonable – we are talking about cold hard cash and reality that insurance companies like to keep their money. There is a possibility that when you hired this make-believe contractor that you did not confirm via a certificate of insurance that “they” – had workers compensation. Checking on their insurance coverage at the time may have seen insignificance at the time – because remember they are a subcontractor responsible for their own welfare… This can possibly backfire on you and your company.

There is more

I will be working on in writing about workers compensation’s throughout the end of this year, remember you need to have a good agent that can break down the different scenarios for you and show you your exposures which is what you could end up being ultimately responsible for in case of an accident.
